These Terms & Conditions apply to (a) your use of the dutchub website and dashboard (Part A), and (b) the sale of products by us (Part B). The general provisions at the end apply to both. By using the website or dashboard, or by placing an order, you accept these terms. If you act on behalf of a company, you confirm you are authorised to bind it.
You may use the website for lawful purposes and in line with these terms. We may update, change or remove content at any time. The information on the website is provided for general information and does not constitute professional advice.
Access to the dashboard may require an account. You are responsible for keeping your login credentials confidential and for all activity under your account, and you must provide accurate information and keep it up to date. We grant you a limited, non-exclusive, non-transferable right to use the dashboard for your own business purposes.
Data shown in the dashboard is provided for information and is drawn from marketplaces and other systems. We do not warrant that it is error-free, complete or continuously up to date, and any decision you take based on it is your own responsibility. Where we process a partner’s data on that partner’s behalf, the applicable agreement and our Privacy Policy govern that processing.
You must not misuse the website or dashboard. In particular, you may not:
We may suspend or terminate your access if you breach these terms.
All content on the website, including text, design, graphics, and the dutchub name and logo, is owned by Elite Parts B.V. or its licensors and is protected by intellectual property rights. You may not copy, reproduce, distribute or otherwise use it without our prior written permission, except as permitted by law.
Third-party brand, product and marketplace names and logos shown on the website are the property of their respective owners and are used for identification and descriptive purposes only. Their appearance does not imply endorsement of, or affiliation with, dutchub beyond the relationship described on the website.
We do not warrant that the website and dashboard will always be available, uninterrupted, secure or free of errors or harmful components. We may modify, suspend, limit or discontinue all or part of them, or change features, at any time, without being liable to you.
The website may link to third-party sites (for example, marketplaces or partner sites). We have no control over them and are not responsible for their content, availability, or their privacy and cookie practices. A link does not imply endorsement.
To the extent permitted by law, dutchub is not liable for any indirect or consequential loss or damage arising from the use of, or inability to use, the website or dashboard, or from reliance on their content. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law. For business users, liability is further addressed in section B7.
This Part applies to all sales of products by Elite Parts B.V. (dutchub), whether through online marketplaces on which we sell as the seller, or directly with business customers. Where you buy as a consumer, sections B5 and B6 apply. Where you buy as a business customer, section B7 applies and the consumer provisions do not. If you order through a marketplace, that marketplace’s own terms may also apply to your use of the platform; this Part governs the sale of the product by dutchub.
By placing an order on a marketplace, you make a binding offer to purchase. The contract of sale is concluded once we accept your offer, either by an order confirmation or by dispatching the goods. The pre-contractual information (essential characteristics, total price including VAT, and any shipping costs) is shown on the product page.
Prices are stated in euros. For consumers, prices include all taxes (including VAT); for business customers, prices are stated excluding VAT unless indicated otherwise. Shipping costs, where applicable, are shown before you complete payment. We accept the payment methods offered at checkout (for marketplace orders, those provided by the marketplace). Payment is due once the order is confirmed. Ownership of the goods passes only once payment has been received in full (see also B7).
We deliver to addresses across Europe. Delivery times are indicated at the time of payment. If a delivery is delayed, we will inform you by email. Risk of loss or damage passes to a consumer on delivery; for business customers, risk passes in accordance with B7 and the agreed delivery terms.
If you are a consumer, you have a statutory right to withdraw from a distance purchase within 14 days of receipt, without giving a reason. dutchub voluntarily extends this period to 30 days from receipt. To exercise this right, you can contact us by email.
We may assess returned products. Where there is a diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, we may deduct a reasonable amount.
For consumers, all our products are covered by the statutory guarantee of conformity (Directive (EU) 2019/771; Articles 7:17 ff. of the Dutch Civil Code) and protection against non-conformity and hidden defects. These statutory guarantees apply regardless of any commercial guarantee offered.
The following applies where you buy in the course of a trade, business or profession:
We process personal data in accordance with our Privacy Policy, and use cookies in accordance with our Cookie Policy.
If you have a complaint, please contact us first at hello@dutchub.com. We will do our best to resolve it with you.
dutchub is not affiliated with an independent dispute-resolution (ADR) body and is not obliged to use one. If we cannot resolve your complaint together, you always retain the right to submit the dispute to the competent court. Consumers in the EU can also find information and assistance through the European Consumer Centres Network (ECC-Net) at eccnet.eu.
These Terms & Conditions are governed by Dutch law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory consumer-protection provisions of the country where the consumer is habitually resident also apply, and a consumer may bring proceedings before the courts of their place of residence. For business customers, any dispute will be submitted to the competent court in the district of our registered office in the Netherlands, unless mandatory law provides otherwise.
We may update these Terms & Conditions from time to time. For a purchase, the version that applies is the one in force when you place your order; for use of the website and dashboard, the version published on this page applies.
